Update: [REDACTED] threatens ex employee with legal action after refusing to provide a contract and owed wages
Note (10/05): Following the resolution of this case, this post has been edited for anonymity. A future update will give more details on the resolution of the case.
Following our last update, the employer, [REDACTED], has paid part of the owed wages. Jan is still owed a considerable amount of money, though, and has yet to see an employment contract and a payslip, which the company is legally obligated to provide. The refusal by [REDACTED] to send a payslip prevents us from seeing which part they have agreed to pay and which part they have refused. We can’t see if they have even attempted any meaningful calculation of how much is owed to begin with. At this point, for all we know, their strategy might just be to throw some sum of money around and hope Jan will settle for less than he’s owed. Still, we see this update as a partial victory: the fact that the employer quickly paid after they felt pressure means that they know they are in the wrong and that this is not a fight they can win. Of course, we don’t plan on stopping until Jan gets what he’s owed and [REDACTED] has at the very least filled their legal obligations.
After we reiterated the employers’ obligation to send a payslip explaining their calculations and the amount they’ve sent, [REDACTED] has threatened legal action against both Jan and Horeca United if we keep pursuing the claim. This suggestion is pretty laughable — he even referenced the legal article which obliges them to provide a payslip in his previous email to us… now he wants to turn around and threaten to take us to court for demanding they abide by it. All workers know how ego-tripping bosses get aggressive when you stand up for yourself, but this is just a sign that they know they’ve been caught messing up and they don’t know what to do. We always have power when we stand united.
